Staff members and a student at a De Forest elementary school filed a lawsuit Tuesday claiming that negligence by the school's builder, J.H. Findorff & Son Inc., Madison, produced toxic mold that led to health problems.
Richard Lynch, Findorff's executive vice president, denied any wrongdoing on the company's part. Findorff completed Yahara Elementary School in 1992, and in the last decade the firm hasn't heard of any complaints from the De Forest Area School District.
When the mold problem first came to light in March 2002 - and consequently shut the building down - Lynch said Findorff representatives called the district to ask if the company could take any steps to remediate the problem.
"We built the school 10 years ago and have not been contacted for any problems at the school," he said. "The district has been very happy with us. We were really surprised by the claims that weren't from the School District but from individuals within the district."
