Section: Government and Politics - Constitution judges face major dilemma as auditor-general fiasco grinds on with bid to replace her To rule or not to rule? That is the question the Constitution Court will on Thursday try to answer in relation to the Jaruvan Maintaka case, The Nation reports.
While the judicial debate probably won't end on Thursday, the outcome really is a sideshow to the main legal epic, which began way back in 2001.
The latest round of litigation brought by the State Audit Commission (SAC) will not be the end of the matter.
Rather it is a shameful ploy, citing legal mumbo-jumbo, in a bid to camouflage a tyranny of numbers, the fact a majority is bent on devising a convenient exit for Jaruvan in the wake of an injustice against her.
As the 14 judges begin to examine whether they should rule further on the case, after their verdict last year ultimately led to even more confusion rather than settlement, legal pundits are concerned this additional litigation might prove futile.
Debate on the Jaruvan case will reach an acceptable solution only if relevant parties, particularly the political majority seemingly determined to remove the auditor-general, stop manipulating the law and begin rectifying their mistakes.
