JOE KERNEN, CNBC ANCHOR: Let`s get right to this next interview, Merck is on the defensive after losing its first Vioxx case. A Texas jury hit the pharmaceutical giant with a $253 million damage award which the company will appeal. It`s going to be lowered anyway by Texas law. Yesterday we did speak to the plaintiff`s attorney, Mark Lanier, who said there is easily going to be 50,000 more case against Vioxx. And today we are going to speak with a representative of Merck. And Kenneth Frazier is general counsel for the Pharmaceutical company. He joins us now from New York.
And good morning, Mr. Frazier.
KENNETH FRAZIER, GENERAL COUNSEL, MERCK & COMPANY: Good morning.
KERNEN: I guess we will start off by just asking you, what happened down there in Texas?
FRAZIER: Well, as you know, we`ve expressed our desire and our intention to appeal and the reason is because we believe the verdict that was obtained in Texas was obtained through a fundamentally flawed trial process where information and evidence that was completely flimsy and unreliable was provided to the jury.
KERNEN: The -- I guess you are talking about bringing in the coroner after it was already too late to use it, the judge allowed that. For some reason the jury just seemed to accept that -- the possibility that there was a -- I guess, a blood clot for a very brief period of time that could have caused...
