JOE KERNEN, CNBC ANCHOR: The other big story, of course, the fallout from that Vioxx verdict and it continues. Merck (MRK) was found liable in the death of a 59-year-old tri-athlete who used Vioxx. A Texas Jury awarded the man`s widow $229 million for pain and suffering and $24 million in actual damages. All of these probably will be reduced. But certainly ominous sign for Merck. The stock plunged on the news, down almost 8 percent. But it is not over.
Merck`s attorney, Jonathan Skidmore, plans to appeal.

JONATHAN SKIDMORE, MERCK ATTORNEY: Part of the reason for an appeal is that there still is no reliable scientific evidence in the record, this case that went to the jury, of the link between Vioxx and Mr. Ernst`s death.
