Courts toss economists: What's this ... federal courts rejecting economists' testimony as not necessarily "expert"?

A study by Robert Badal and Edward Slizewski in Heller Ehrman White & McAuliffe's Los Angeles office says that federal district courts have grown comfortable disqualifying the proffered testimony of economists since the Supreme Court's decisions in Daubert v. Merrell Dow Pharmaceutical, Inc. (509 U.S. 579, 113 S. Ct. 2786 (1993)) and Kumho Tire Co., Ltd. v. Carmichael (526 U.S. 137, 119 S. Ct. 1167 (1999)).

Essentially, the cases stand for the proposition that courts should inquire as to the scientific basis of expert testimony under Rule 702 …
