Jul. 2--WASHINGTON, D.C.--Now that a federal appeals court has dismissed two of the Justice Department's three claims against Microsoft Corp., the conservative President Bush might prefer to be as hands-off as possible about penalizing the software Goliath.

But circumstances may not permit that.

The rap, fair or not, that the administration has taken for being too pro-business on environmental and energy issues, some analysts say, may force the Justice Department to take substantial action for the remaining finding against Microsoft--that it illegally acted to protect its Windows software monopoly.
