Conseco tries to tie ex-CFO to fraud.

Feb. 4--As attorneys for Conseco Inc. prepare their case for an April 11 trial against Rollin M. Dick, they are trying to prove that Dick not only owes the company money but also committed fraud to hold onto tens of millions of dollars in assets.

Conseco says Dick deceived it into refinancing debt he and his family owed the company in a manner that made him the sole debtor. He then transferred his assets to his wife, the company says.

Attorneys for Dick, who was chief financial officer for Conseco, have vehemently denied Conseco's claims. But they failed to persuade a Boone County judge to dismiss them before trial.

"This one issue of fraud, it's just poppycock," said Linda Pence, an attorney for Dick. "That is the silliest, most nonsensical argument we have ever …
