CHICAGO _ Lawyers for R&B superstar R. Kelly filed a flurry of motions on his behalf Monday in an attempt to have his child pornography indictment dismissed or at least to limit the case against him.
Kelly's attorneys filed 11 documents in the courtroom of Cook County Circuit Judge Vincent Gaughan, challenging the 21-count indictment returned against the singer last year.
He was arrested in June 2002 after a videotape surfaced in which he allegedly has sex with an underage girl.
Among the filings was a motion to dismiss the indictment because of the state's "failure" to specify the date of the alleged occurrence of the crime.
The document notes that prosecutors have alleged the illegal conduct took place between November 1997 and February 2002. The Illinois Supreme Court has held that a date should be established for the crime in question, Kelly's lawyers argue, and the window is too broad for Kelly to mount a fair defense.
"It's no secret that Mr. Kelly is a well-known musician, who frequently travels," the motion states. "By failing to narrow the date of the charged offense, Mr. Kelly is wholly deprived of the opportunity to bring an alibi defense."
