Aug. 14--The Institute for Justice argued Monday in New London Superior Court that the Fort Trumbull Municipal Development Plan was created to accommodate Pfizer Inc.'s needs, alleging that the city and New London Development Corp. are illegally using the powers of eminent domain to seize homes to benefit the company.
The institute presented a letter, an e-mail and oral testimony to show that Pfizer had expressed interest in the development of a hotel/conference center, residential units, biotech offices and an extended-stay hotel long before the MDP was approved in January 2000, and that all of its suggestions were ultimately included in the MDP.
Eminent domain laws allow a municipality to take, and compensate owners for, properties that are needed for roads, schools, firehouses, police stations and other public uses. The law does not authorize eminent domain to be used for private development.
The trial resumed Monday with the institute calling William Longa, senior corporate council for Pfizer, as its witness. The trial began on July 23 and continued for a week with more than a dozen witnesses testifying.
