Oct. 27--The Canadian government yesterday asked for a rehearing of a decision it lost recently in a federal appellate court in its lawsuit against R.J. Reynolds Tobacco Holdings Inc., in which it accused the company of smuggling cigarettes into Canada.
A three-judge panel of the 2nd U.S. Circuit Court of Appeals on Oct. 12 affirmed a lower court's dismissal by a vote of 2-1 of the lawsuit filed by Canada against RJR, its R.J. Reynolds Tobacco Co. unit, several currently and formerly linked companies and the Canadian Tobacco Manufacturers Council, which alleged that the companies violated U.S. racketeering laws by conspiring to defraud …
