Apr. 26--TALLAHASSEE, Fla.--The same Leon County judge who decided last month that the state's experimental voucher program was unconstitutional is allowing it to expand throughout the state while his ruling is appealed.
On Tuesday, Circuit Judge L. Ralph Smith dismissed voucher opponents' arguments that allowing the program to continue in the midst of continued legal wrangling would be an undue burden on schools as well as students who might have to change course if the program is ultimately struck down by the state Supreme Court.
The ruling means that this year, as many as 26,000 students in Miami-Dade County and 78,000 statewide could become eligible for so-called "Opportunity Scholarships" to attend...
