* Generic Drugmakers Illegally Agree To Slow Market Entry, Says FTC. The Federal Trade Commission April 2 charged the Schering-Plough Corporation and two generic drug manufacturers, Upsher-Smith Laboratories and American Home Products Corporation, with agreeing to slow the market entry of generic versions of a potassium chloride supplement that's prescribed to many patients who take certain blood-pressure medicines.
When Upsher-Smith and American Home sought FDA approval to market generic versions of the supplement, Schering filed patent infringement suits against them, which the companies later settled by agreeing to delay their market entry in exchange for money, FTC alleges. The companies argue the agreements were legal.
