Wine drinkers planning to add a mail-order California port or merlot to their cellars will have to wait until the U.S. Supreme Court decides whether to consider a state debate of wine shipping law.
In August, the U.S. 6th Circuit Court of Appeals ruled the state's restrictions on out-of-state wine shipping violated the U.S. Constitution's ban on the interstate commerce restrictions clause. By forbidding direct shipments to wine buyers, the state was impeding interstate trade, the opinion said.
It's the same law that has made it impossible for Michigan legislators to keep Canadian trash out of state landfills.
In the case of wine, the appeals court ruling would void the law preventing sale of wine by mailing lists, catalogs or on the Internet.
