DALLAS _ Fleming Cos. on Tuesday filed for bankruptcy protection and lined up financing to keep the company going. But the terms behind that lifeline may be a tough sell in court, legal experts said.
The bankruptcy filing ended months of speculation on how nation's largest grocery distributor would deal with a $4.5 billion-a-year Kmart Corp. contract that shrank and finally disappeared.
In the end, the need for money to pay employees and suppliers in the short-term forced Lewisville, Texas-based Fleming to seek Chapter 11 bankruptcy.
Now that financing struggle is at the core of whether the 88-year-old company with Oklahoma roots will be allowed to successfully reorganize in U.S. Bankruptcy Court in Wilmington, Del., where it filed.
