Aug. 22--A New Mexico recycler that sent used oil to Ekotek Inc. -- and later was tapped for cleanup costs at the polluted site -- is not covered by its insurance policy, a federal appeals court decided.

Mesa Oil Inc., Albuquerque, is one of hundreds of businesses and agencies that sent oil to the Ekotek recycling facility in Salt Lake City. The Environmental Protection Agency (EPA) closed Ekotek in 1988, and customers were handed part of the bill to rectify widespread soil and groundwater contamination.

Mesa Oil argued its policy with the Insurance Company of North America (INA) should cover its $193,000 settlement with EPA.
