Florida's Third Circuit Court of Appeals has ruled in favor of a retrial in the Lorenzo Peterson case, in which a $104 million judgment--the largest personal injury award in the state's history--was levied against Sta-Rite for an entrapment accident.
In 2000, then 14-year-old Peterson reached into the main drain of a Miami apartment pool and got his arm stuck. The cover had been loose for some time, according to witnesses, and Peterson's friend removed it shortly before the accident. The boy remained underwater more than 12 minutes and fell into a vegetative state after being rescued. He died last September.
During the appeal, the panel of judges agreed with the jury's conclusion that Sta-Rite's pump was defective because it didn't have an automatic shut-off device. The panel also agreed that the Delavan, Wis., manufacturer failed to provide ...
