KAUAI, HAWAII -- Attention to the top eight reasons for laparoscopic malpractice claims could help you avoid being sued, J. Douglas Peters, J.D., said at a conference on obstetrics, gynecology, perinatal medicine, neonatology, and the law.
Data from the Physicians Insurers Association of America, whose members cover a majority of U.S. private practice physicians, show that close to half of 615 malpractice claims relating to laparoscopy involved cholecystectomies, with general surgeons the most common targets of the suits. Of the 284 suits not involving general surgeons, 90% named ob.gyns. as defendants, said Mr. Peters of Detroit.
Across all procedures, bowel perforation was the most common injury. In gynecologic surgeries, ureter laceration was the most common injury. Some of the lawsuits did not allege malpractice in the form of a direct injury but cited failure to notice complications and to react appropriately, he said at the conference, sponsored by Boston University.
