Green campaigners are taking legal action against Swindon council in a bid to halt a "hazardous and hostile" road scheme which will open the door for a controversial M4 tunnel.
The High Court proceedings could potentially prevent anyone from moving on to Swindon's 4,500-home Front Garden development, where the first houses are currently being built.
Campaigners claim that it was "arguably unlawful" for the council to discharge a traffic agreement called Condition 99, allowing a key road to be driven from junction 16 of the M4 to the Front Garden, via a new tunnel.
Last year, neighbouring Wiltshire County Council voted not to support the proposed road alterations because they felt the scheme could be dangerous for pedestrians and cyclists and would not encourage public transport.
But earlier this year, Swindon council agreed to discharge the condition, which paved the way for house building to begin at the Front Garden, now known as Wichelstowe.
