In March 2007, the U.S. Court of Appeals found by a 2-1 vote that the District of Columbia's ban on handguns in homes is unconstitutional after correctly interpreting the Second Amendment as conveying an individual right to firearms ownership. It was a short-lived victory--the decision was appealed and the case is now before the Supreme Court.

On January 11, the Bush administration weighed in with its opinion in a brief filed by Solicitor General Paul D. Clement. According to the administration, the lower court finding "could be read to hold that the Second Amendment categorically precludes any ban on a category of 'Arms' that can be traced back to the Founding era."
