While patrolling Rocksprings, Texas, late on the night of April 14, 2005, deputy sheriff Gilmer Hernandez pulled a vehicle over for a routine traffic stop. The driver of the car pulled away, trying to run Hernandez over. Officer Hernandez responded by firing four to six times at the fleeing vehicle, blowing out a tire. When the car came to a stop, the occupants all fled except for one female illegal immigrant who took some shell fragments in the arm.
Rocksprings Sheriff Don Letsinger defended the actions of his deputy, and an investigation by the Texas Rangers concluded Hernandez did nothing wrong in discharging his weapon given the situation.
