In response to a motion to dismiss the case against Jose Padilla, Judge Marcia Cooke in February ordered the Bush administration to turn over video footage of Padilla's interrogations when he was held as an enemy combatant. Padilla is the alleged "dirty bomber" who was held without charge by the Bush administration for more than three years.

In response to Judge Cooke's order, the administration claimed that one of the crucial DVDs containing video footage from March of 2004 was missing.
