The firing of eight U.S. Attorneys is the subject of much debate and rhetoric by pundits on all sides. Far too little attention has been paid to a rules change introduced by Sen. Arlen Specter (R-Pa.) in the 2006 reauthorization of the U.S. Patriot Act that eliminated the process of requiring congressional approval of these appointees. One more "frivolous" check and balance gone, from a Republic historically of three separate yet equally powerful branches of government.

The omission of Attorney Johnny Sutton ("Betrayed in the Line of Duty," September 18, 2006) from that group causes much concern. His zealous prosecution of two Border Patrol agents relied heavily ...
