A successful pleural plaques test case could result in damages rising for the condition, in marked contrast to insurers' aim of denying compensation completely.
Law firm Field Fisher Waterhouse won GBP26,000 damages last week for a client with pleural plaques, which, according to the Court of Appeal, should not be compensated in English Law.
Peter Williams, partner at FFW, said: "The case will re-establish the principle that cases for pleural plaques have different values depending on the age, profession and so on."
Ellis Hindson, 59, of Doncaster, South Yorkshire was exposed to substantial amounts of asbestos and was diagnosed with pleural plaques.
