Judgment in the Thompstone v Tameside and Glossop case could have the greatest impact on reinsurers, according to a leading firm of actuaries.
Lane Clark and Peacock has warned that: "If this judgment is upheld, it will break the link between periodical payments and the retail prices index." Thompstone has appealed the judgment, and the case could go beyond the Court of Appeal to the House of Lords.
Joe Monk, partner at LCP, who provided expert witness testimony at the hearing, said: "The judgment should have a greater impact on reinsurers.
"They should take an active interest in settlements and should see more of these cases than insurers."
