There have been a rash of court decisions addressing preferences over the past year. Recently, the United States Bankruptcy Court for the Southern District of Indiana, in In re Paul Harris Stores, Inc., addressed one of the elements of a preference claim: the transfer enabled the creditor to receive more than it would have received in a Chapter 7 liquidation case.
The court ruled that the defendant had a full defense to preference exposure because it was a fully secured creditor of the debtor.
