Canada's rapid ditching of its copyright agreement on pharmaceuticals in the first few days of the anthrax scare has given new hope to African countries that they will secure a change in the World Trade Organisation rules.
The US government also twisted the arm of the German pharma giant Bayer, the supplier of the main anti-anthrax antibiotic, Cipro to secure a lower price.
In Canada Bayer was outraged and threatened legal action against the government; eventually an agreement was reached whereby the generic drugs bought by the Canadian government was stockpiled and fresh supplies of Cipro were bought from Bayer.
However, the case has emphasised the overriding nature of a medical emergency, in which developed countries clearly believed the national interest came before the international patent laws.
