The Chicago Board of Trade remains hopeful that a resolution can be reached in a dispute involving the contract covering its Alliance/CBOT/Eurex (a/c/e) joint venture with German-Swiss derivatives exchange Eurex. But an industry source said the a/c/e contract contains a clause providing for arbitration in London in the event of a major disagreement between the two partners.
"The arbitration clause was included in the original contract," the source said. "Electing private arbitration is not unusual in situations involving business partners under different jurisdictions. In the a/c/e case, arbitration, if it comes to it, would take place in London."
