A federal Judge in Kentucky has refused to certify a class of plaintiffs in litigation against Purdue Pharma LP, the Stamford, CT-based distributor of OxyContin (oxycodone HCl controlled-release) Tablets. In the Judges' opinion, a court will not allow a class action lawsuit under the Federal Rules of Civil Procedure unless the proposed class can be defined and its members identified clearly. The plaintiffs in the Gevedon case, among other claims, had accused Purdue Pharma of promoting, marketing and selling the prescription pain medication OxyContin in a misleading …
