: The Karnataka High Court on Thursday stayed the operation of BDA's authority to collect property tax and certain other laws (amendments) promulgated by Governor V.S. Ramadevi on December 20, 2001.
Chief Justice N.K. Jain and Justice S.B. Majage submitted a writ petition filed by B. Krishna Bhat of Bangalore, challenging the constitutionality of the ordinance.
The petitioner contended that the erstwhile Bangalore City Improvement Trust Board (CITB) and its successor, the Bangalore Development Authority (BDA), had no legal authority to levy and collect property tax because the law hadn't conferred such power.
The high court and apex court had upheld the petitioner's contention observing that levy and collection of property taxes during that period had no authority of law. Tax-payers could demand the refund of such taxes.
