Allstate Corp. has fired the latest volley in a long-running employment dispute by countersuing 28 current and former agents, accusing them of committing fraud in taking legal action against the company after signing release-and-waiver agreements.
In its counterclaim filed March 11 in U.S. District Court for the Eastern District of Pennsylvania, Philadelphia, Allstate says the agents misrepresented their intentions, acted unfairly and were unjustly enriched by their actions, causing the company to provide them with the interest in their books of business, as well as benefits and payments, in exchange for signing the agreements. The Northbrook, I11.-based insurer has requested compensatory, punitive and other damages.
The agents filed their lawsuit against the company in the same court in August 2001, claiming the insurer unfairly terminated about 6,400 agents in 2000 and violated federal employment-practices regulations. They are seeking class-action status.
