TOKYO, April 1 Asia Pulse - The Tokyo District Court on Tuesday ruled in favor of Pfizer Pharmaceuticals Inc. in a trademark violation lawsuit filed by the Japanese subsidiary of Pfizer Inc. of the U.S. against Yasuido International, Pfizer Pharmaceuticals officials said.
The suit claimed that Yasuido, which imports drugs for sale directly to individuals, violated Pfizer's trademark rights on Viagra, a prescription drug for erectile dysfunction.
The district court ordered the importer to pay 50.24 million yen (US$378,478) in compensation to Pfizer and provisionally called on the firm to scrap billboards, advertisements and Web sites featuring the Viagra trademark.
The importer, whose operations skirt the law governing pharmaceutical imports and sales by offering products directly to consumers placing orders for drugs, was found by the court to be within the remit of the law and thus guilty of violating Pfizer's ...
