MAGISTRATE Peter Chanda erred when he acquitted former intelligence chief Xavier Chungu, the state has submitted in its appeal against the acquittal.

According to the grounds of appeal filed in the Lusaka High Court, the state has alleged that magistrate Chanda misdirected himself on a point of law when he ruled that the prosecution evidence adduced could not warrant putting Chungu on his defence.

Chungu was recently acquitted on five counts of theft of motor vehicle and seven counts of theft by public servant by Lusaka magistrate Peter Chanda.
