XAVIER Chungu should be acquitted of charges of motor vehicle theft, his lawyer Nicholas Chanda has submitted before magistrate Peter Chanda.

According to submissions filed on August 25, Chanda stated that the state had failed to establish a case against his client. Chanda was making the submission in a case in which his client, Chungu, is charged with 11 counts of motor vehicle theft.

Chungu is between February 2002 and September 2002, charged with theft of five motor bikes, three boats and three watercraft. Chanda stated that the trial should not have commenced if the prosecution …
