The following statement is attributed to Stephen Burrows, Chief Executive Officer and President of Anheuser-Busch International, Inc. (NYSE: BUD):
Anheuser-Busch has exclusive rights to the Budweiser trademark in Japan, and these rights remain unchallenged. In addition, Anheuser-Busch has held the exclusive rights to the Budweiser mark in Japan since it registered the trademark there in 1951. The ruling by the Tokyo High Court has no effect on Anheuser-Busch's ability to continue selling Budweiser in Japan.
Budejovicky Budvar and certain importers and distributors began distributing beer in Japan in packaging using the term "Budweiser" in association with other terms. Consequently, we commenced court proceedings against them because we believed the packaging and labeling on Budvar's products infringed our trademarks and created unfair competition.
The Tokyo District Court's earlier ruling upheld Anheuser-Busch's rights to use and protect the Budweiser trademark and stopped two distributors from using the Budweiser Budvar trademark. In ...
