SHAH ALAM, Mon. - The case against former aircraft cabin cleaner Ahmad Najib Aris in the Canny Ong trial is circumstantial with no conclusive evidence that he raped and murdered the information technology analyst, the High Court heard today.
Defence lawyer Mohamad Haniff Khatri Abdulla, in his submission, said the prosecution could not adduce evidence to prove beyond reasonable doubt that Ahmad Najib was responsible for her death.
The prosecution had, therefore, failed to prove a prima facie case, he added.
He said the court should reject the prosecution's contention that Ahmad Najib was the last person with Ong between the night of June 13 last year and the next morning.
"The prosecution is relying on circumstantial evidence by Lance Corporal S. Ravichandran, Aminah Ishak and Azizam Ismail in identifying him." Ahmad Najib is accused of raping and murdering Canny Ong Lay Kian, 28, between 1am and 5am at 7th Mile, Jalan Klang Lama, on June 14, 2003.
Haniff was submitting at the end of the prosecution's case before High Court judge Datuk Muhamad Ideres Muhamad Rapee.
