The Court of Appeal gave permission to appeal where one party alleged the other party had perpetrated a fraud in giving false evidence at trial. Couwenbergh, a beneficiary under a previous will, disputed the validity of a will under which Valkova was the sole beneficiary.
At first instance, Couwenbergh lost and his application for permission to appeal was refused. Subsequently, police enquiries revealed witness evidence that the last will had not been properly executed, which cast a suspicion of fraud on Valkova. Couwenbergh, relying on this evidence, applied again for permission to appeal.
