From 1 June 2004, all road traffic accident cases that occurred after 5 October 2003, and which are funded by conditional fee agreements, are subject to a fixed success fee of 12.5% for cases that settle before trial and 100% for those that go to trial. Exceptional cases, such as complex high-value claims, will be subject to individual assessment.
The Department for Constitutional Affairs has also announced that an agreement, adopting the RTA model, has been reached on success fees in employers' liability cases. This is fixed at 25%, unless the CFA is funded by a members' organisation, such as a trade union, in which case the success fee is 27.5%.
