The comfort level that credit executives have reached in the last several years regarding "critical vendor" treatment has come to an end. This is the first time this issue has reached the Circuit Court level, and this is the first case of such magnitude to address this issue. A discussion of the 7th Circuit decision in the Kmart case would be incomplete without a preliminary discussion of the background to "critical vendor" payments.
