New Mexico's Mechanics' and Materialmen's Lien Law is modeled on and derived from California's constitutional protection of mechanics and materialmen. Accordingly, New Mexico has traditionally been exceedingly protective of the rights of companies providing labor or supplies toward the improvement of real property. However, mechanics' lien laws were not recognized under the common law, so are strictly construed when determining whether an individual has a right to claim or enforce a claim of lien against real property.
