The maker of Mallo Cups and Smoothies is back in business. Altoona, Pa.-based Boyer Candy Co. resumed production this summer after ceasing operation in December 2002.

The company has been bogged down with legal wrangling for two years following the death of company president Anthony Forgione in 2001. His former wife, Deborah Forgione, sued in an attempt to oust Boyer CEO Roger Raybuck and to regain control over company shares she maintained she had been forced to relinquish.

In April, a court appointed Roy Mollomo, a onetime colleague of Anthony Forgione, but newcomer to Boyer, as interim trustee. Mollomo set to work on bringing Boyer back, and he has been …
