Having failed spectacularly at plunder and giving way to more talented practitioners, Joseph "Erap" Estrada is rotting in jail with his busted knees. He was not even invited to the recent movie gala of Luis "Chavit" Singson. But President Macapagal-Arroyo led many of the heroes of Edsa II at the glittering civil society affair. The great statesman Jose de Venecia, welcomed "all our family of sunshine coalition partners and allies." It would have made Michael Corleone proud of such Sicilian amity in the afterglow of a thermonuclear ruling that leaves the House and Constitution reeling. Not Danding or the Brat Pack, who are still in the sunshine coalition.

But it rained long and hard on that parade the very next Wednesday. "When" you become President of the Philippines, will you pardon Joseph Estrada and set him free, FPJ was asked. To which he simply said that since Erap has not been convicted, there is no sentence to commute or crime to pardon.

Yet, whoever wins the 2004 election decides which plunder cases to pursue. For there are many chunks of P50 million that have been plundered since Edsa II. Who will deny that Jose Velarde's evil society has been matched in corruption by Jose Pidal's civil society? The only difference is that one of them allegedly has the Supreme Court in his pocket too.

Which is why, I've been spending my time in the close company of Supreme Court Justices Conchita Carpio Morales (Francisco Jr. vs House) and Reynato J. Puno (Estrada vs Arroyo). Their lethal prose is transforming the judiciary into a proving ground for moralistic theories about coordinate government that are beyond the pale of what is fit for the survival of democracy, like the one-third rule. In establishing the supremacy of judicial review, twice the justices have absolved themselves of possible culpable derelictions with their own gavels. They have overthrown one presidency and overruled the House with these holy screeds.
