The city council is taking Wolverhampton and Dudley Breweries to court in a case relating to the Slug and Fiddle pub in Upper Parliament Street.
The council claims that in August 2001, the city pub was stocking under-strength bottles of whisky and gin.
In a preliminary ruling at Nottingham Magistrates' Court, District Judge Robert Zara found that the brewery could not be prosecuted as only the licensee could be said to "sell" alcohol.
