On October 12, 2005 (70 FR 59402), EPA finalized air emission standards under the Clean Air Act (CAA) for hazardous waste combustors. The standards, which are based on the concept of maximum achievable control technology (MACT), impose stringent limits on hazardous air pollutant (HAP) emissions from all regulated major and area sources.

On March 23, 2006 (71 FR 14665-14673), EPA announced that it had granted a petition requesting review of the emission standard for particulate matter (PM) for new cement kilns that burn hazardous waste. The standard was set at 0.0023 gr/dscf corrected to 7% oxygen ([O.sub.2]) in the October 2005 rule. In response to the petition, the agency has proposed revising the PM standard for new cement kilns to 15.8 mg/dscm (0.0069 gr/dscf) corrected to 7% [O.sub.2]. The rule also proposes corresponding changes to the new source PM standards for incinerators and liquid fuel boilers. On April 13, 2006 (71 FR 19155), EPA extended the comment period on the proposed rule from April 24, 2006 to May 8, 2006.

Accordingly, the agency also issued an administrative stay of the PM standard for new cement kilns (71 FR 14655-14656; March 23, 2006). During the period of the stay, which will expire June 23, 2006, the PM standard of 0.15 kg/Mg dry feed will apply. The rulemaking actions affect 40 CFR Part 63.

Applicability

The March 23, 2006 proposed rule and administrative stay apply to the following units that burn hazardous wastes:

* Cement kilns,

* Incinerators, and

* Liquid fuel boilers.
