FOR THE FIRST TIME in the twenty-three years since the legislation was passed, the High Court has an opportunity to make a ruling on Australia's Freedom of Information (FOI) law. This will probably happen in August. Ric Snell, senior lecturer in law at the University of Tasmania and our leading academic authority on FOI, believes the length of the court's silence is without precedent. In most other countries with FOI legislation--probably more than 100--their highest court has heard appeals and made seminal rulings within one to five years.
