An at-will nursing home employee who was fired for reporting abuse to state regulators can sue for wrongful discharge in violation of public policy, the Nebraska Supreme Court has ruled.
The plaintiff worked as a staffing coordinator at a nursing home. She was aggressively reprimanded and fired after discovering an unreported injury at the home and reporting it to state regulators.
She sued for wrongful termination, claiming that state law required her to report the abuse. A jury returned a verdict in her favor and awarded $79,000.
The nursing home appealed.
