After perusing the evidence, District Attorney Doug Harcleroad determined that a man who was attacked in his apartment by an intruder was acting in self-defense when he shot and killed the intruder.
According to the Register-Guard of Eugene, Oregon, Tony Hernandez answered a knock at his apartment door at about 5 a.m. on February 10. When he opened the door, a stranger, later identified as John Rippet, attacked him, beating him on the head and body with a collapsible metal baton, opening up gashes on his head.
