This case involved a 75-year-old woman who sustained extensive bruising to her body and an aggravation of her pre-existing back problem when the defendant made an illegal left-hand turn in front of her. There was substantial front-end damage to the plaintiff's vehicle and the air bags deployed causing severe bruises to her chest, breasts, stomach and back. The plaintiff had a pre-existing back problem which was aggravated by the accident. After being rushed to the emergency room, she was treated and released. The plaintiff followed up with her family doctor and received two regimens of physical therapy from Aug. 6, 2003 to Oct. 29, 2003. Thereafter, she went to see the doctor periodically and occasionally complained of back pain. The defense argued that the plaintiff had compression fractures to her back before the accident and that according to her physician and the physical therapist her injuries were considered to be mild.
