THE NETHERLANDS' attractiveness as a jurisdiction to hear liability cases appears to be confirmed by a recent judgment in Groningen following from a collision between a German and a Dutch fishing vessel in June.
The court confirmed that Dutch law was applicable on the question of limitation of liability, as opposed to German law which has higher liability limits.
Lawyers acting for the German fishing boat had argued that, while the case could be heard in the Dutch courts, German law should apply because the collision allegedly occurred in German waters.
