THE TRIAL OF DAVID HICKS by US military commission should satisfy not only the Australian and US governments, but also their critics--which may come as a surprise to them. A likely but unexpected consequence of the US-Australian arrangements concerning the trial is that in the event of a conviction, Hicks should be able to test the legality of any term of imprisonment in an Australian court. Rather than seeking its delay, and even attempting to take another nationality, Hicks and his supporters should be anxious for the trial to take place.
