The Compensation Bill has failed in its attempt to address the compensation culture, and a much bolder approach is needed, claimed Terry Renouf, national partner at Berrymans Lace Mawer.
"There is very little in the Compensation Bill to tackle compensation. Insurers know, and the insureds know, that the compensation culture is not just a perception but reality because costs are running away. Someone needs to take a bold approach," he said.
Mr Renouf was particularly critical of section one of the Bill, which he said was littered with terms such as "may" and "might" and had "so many conditional clauses it is virtually useless".
He added: "Claims may be stable but you can argue that they should be declining with risk management now being taken more seriously."
